Terms & Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "Renter") and Oxigen ("we," "us," "our") governing the use of our rental services and platform. By accessing, registering, or using our website or services, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations.
If you do not agree to these Terms, please refrain from using our services. You must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction.
Definitions
User: Anyone who accesses or uses the Oxigen platform.
Renter: A User who rents equipment through our website.
Rental Equipment: Products or services available for rent through Oxigen.
Rental Agreement: The legally binding contract formed upon placing an order.
Service Overview
Oxigen provides rental services for work, home office, and lifestyle equipment. Users can browse, book, and rent items for flexible periods with a rental fee.
Platform Use
You agree not to misuse or interfere with the platform, including but not limited to:
Posting false or misleading information.
Attempting to hack, disrupt, or corrupt the service.
Engaging in fraudulent activities.
Eligibility & Registration
Users must be at least 18 years old and capable of entering into a legally binding contract.
Users must provide accurate and complete personal and payment information.
Oxigen may verify identity, email, phone number, age, delivery address, proof of address, and other necessary documents to confirm the User's ability to pay for the rental before processing an order.
To ensure security and prevent fraud, we require users to complete an identity verification process before renting equipment. This verification is conducted by third-party service providers and not directly by us. By using our service, you agree to undergo verification as required. By proceeding with verification, you acknowledge that their terms and privacy policies apply. We are not responsible for any issues, errors, or delays caused by third-party verification services.
In the event of non-payment or failure to return rented equipment, we reserve the right to access and use the provided identification data for the purpose of debt recovery. This may include sharing your information with authorized third parties, such as collection agencies or legal representatives, in accordance with applicable data protection and privacy laws.
If a User fails to complete the verification process or provides inaccurate or fraudulent information, Oxigen reserves the right to reject or cancel the order without liability.
Failure to pass verification may also result in restricted access to our platform or termination of the User’s account.
While verification adds a layer of security, it does not guarantee the legitimacy of any user. We do not take responsibility for fraudulent activities, identity theft, or misrepresentation that may occur despite the verification process.
Booking
Reservation: Users select equipment, specify rental duration, and complete order.
Confirmation: The booking is confirmed only after the user's verification and payment are successfully processed.
Availability: Equipment is subject to stock availability, and Oxigen does not guarantee availability of specific items.
Rental periods
Rental Period
The rental period begins when the equipment is delivered to the User and ends when it is returned.
If the order is delivered later than the estimated time, the rental period will be adjusted accordingly.
Rental periods are displayed at the time of placing an order, and the User agrees to the price and conditions shown.
Minimum Rental Terms & Pricing Tiers
Rentals are subject to minimum rental terms based on the selected tier:
Weekly: Up to 1 month
Monthly (Short-Term): Over 1 month and up to 3 months
Monthly (Mid-Term): From 3 to 6 months
Monthly (Long-Term): Over 6 months
The User agrees to pay the subscription fee according to the chosen tier.
Delivery
Equipment will be shipped to the delivery address provided by the User.
Oxigen may request proof of address for validating delivery address.
Users are responsible for receiving the delivery.
If the package is returned due to an incorrect address or failed delivery attempt, additional charges may apply.
If the User fails to receive the order, additional fees may be charged for re-delivery or a new order.
First payment, including any applicable fees for delivery, insurance, or other add-ons, must be completed in full before order is shipped. Subsequent charges will follow selected Rental Terms & Pricing Tiers (weekly or monthly).
The User has 24 hours after receiving the order to inspect the equipment and verify that it is functional, complete, and includes all necessary accessories, parts, and software. Any missing items or issues must be reported to Oxigen within this period.
Failure to report within 24 hours may result in the User being held responsible for any missing or damaged components.
Return
Users can extend the rental period within the same tier (weekly/monthly) without prior notice.
At the end of the rental period, Users must return the equipment using Oxigen’s designated return service. Users are responsible for requesting a pick-up service for the return.
If the designated delivery service is unable to collect the equipment due to the User’s fault (e.g., unavailability at the pickup location), additional fees may apply for re-scheduling the pick-up.
If you return the Rental item incomplete, we are free to charge you for the resulting damage if you do not promptly return the missing parts of the Rental Item despite being requested to do so.
If Users do not use the return label provided by Oxigen or use a different delivery provider, they assume the risk for loss or damage during shipment.
On the return of the Rental Items, Oxigen will delete all data stored on the Rental Items without a possibility of restoring this data. You must therefore back up the data stored on the Rental Items before You return them.
After the equipment is returned, Oxigen has 48 hours to inspect it and notify the User of any missing parts, damage, or other issues. If any discrepancies are found, the User may be responsible for repair or replacement costs in accordance with Oxigen’s policies.
Care & Responsibility
Users must use the rental equipment responsibly and keep it in a clean and safe condition.
No modifications or unauthorized repairs are allowed.
Equipment must be returned in the same condition as received, considering normal wear and tear.
If the equipment is returned in an unclean condition, we reserve the right to charge a cleaning fee to cover cleaning expenses. Additionally, if defects are discovered after cleaning and inspection, we reserve the right to request compensation for the cost of repairs within 48 hours.
The User agrees to use the rental equipment for its intended purposes only and in a manner consistent with the provided guidelines or instructions. Any misuse, including but not limited to heavy lifting, modification, or improper storage, may result in fees or termination of the agreement.
Damage, Loss & Theft
Users are fully responsible for any damage, loss, or theft of the equipment during the rental period.
The User must inform Oxigen within 24 hours if any damage, malfunction, loss, or theft of the equipment occurs.
Failure to report incidents within this timeframe may result in additional fees or liability for the full cost of repair or replacement.
During the rental period, Oxigen may replace the equipment upon the User's request if the damage or malfunction was caused by Oxigen. Replacement is subject to availability. Users are responsible for ensuring that the equipment remains in working order throughout the rental period. If maintenance is required due to manufacturer faults, Oxigen will provide repair services at no additional charge. Users are required to contact us immediately if they experience any issues.
If an item is damaged, Oxigen may charge for repair or full replacement.
If an item is lost or stolen, the User must notify Oxigen immediately and may be charged the full replacement value.
If the equipment is returned with software locks or password protection, Users must remove them.
Payment & Fees
All payments for rentals must be made in full prior to the delivery of the equipment according to an order fee.
Payments are processed through Stripe Payment Link, and we accept card payments only.
Payment can be made on a weekly or monthly basis, depending on the selected rental option. Additional services and equipment paid before processing the order by us.
Fees are non-refundable, even if the equipment is returned early.
Users may be required to provide additional documents to verify their ability to pay before rental approval.
Upon signing the Rental Agreement, the Renter may be asked to pay a deposit to ensure compliance with their obligations. Oxigen will return the deposit at the end of the Rental Agreement, provided that the Renter has fully met their financial obligations and returned the rented equipment in good condition and fit for use. If the Renter violates the terms of the Agreement, we may withhold all or part of the deposit to compensate for any damages caused by the Renter’s breach of contract.
Late payments, late returns or damaged items may incur additional fees.
The User must ensure the necessary funds are available to cover the subscription fee or any additional charges due (e.g., for late fees, extra services, etc.) on the payment due date. If the User has any outstanding fees or additional charges (apart from the regular subscription), they must pay them on the due date as well.
The User is required to provide the necessary funds for the subscription fee on the agreed payment date. Failure to make the payment by the due date will trigger our payment recovery process. If the initial payment fails, we will make multiple attempts to debit the payment automatically. If 3 payment attempts fail, an additional daily fee will be charged for each day the payment remains unpaid.
If the payment is not received within 7 days of the due date, we reserve the right to:
Suspend the User's account.
Request the return of the rented items through our designated return process.
Failure to return the items may result in additional fees and penalties.
If the payment is still not made within 14 days (after the 7-day grace period), we may transfer the case to a debt collection agency. This may affect the User's credit score and may lead to legal action to recover the outstanding amount.
In the event of non-payment and non-return of rented items, Oxigen reserves the right to report the matter to the police. Legal action may be pursued to recover the items and/or payment owed, which may result in criminal charges for theft or fraud.
Cancellations & Refunds
Users may cancel a reservation up to 48 hours before the scheduled delivery without cancellation fee with a full refund. Cancellations after this period may result in a refund minus a cancellation fee.
If equipment is defective or does not match the description, Users may request a replacement or refund (see Damage, Loss & Theft).
If the User cancels the subscription before completing the agreed rental period, previously paid fees will be recalculated based on the pricing of the applicable shorter-term tier. The User will then be required to pay the difference between the amount already paid and the correct fee for the shorter-term tier. This ensures fairness and transparency, providing equal rights and treatment to all Users. For example, if the User makes an order with a 6-month minimum rental period and decides to cancel after 3 months, we will recalculate the subscription fees already paid for the first 3 months and adjust the fee to reflect what the User should have paid for a 3-month rental tier.
If the User cancels the subscription up to 1 week in advance of the next payment, no cancellation fee will be applied.
If the User cancels the subscription less than 1 week before the next payment, an additional cancellation fee will apply.
Termination of Rental agreement
The Parties have the right to terminate the Rental Agreement with a notice period of one week toward the end of each contract month, without a statement of reasons, but at the earliest, if a minimum term is agreed, toward the end of the agreed minimum term of the contract.
The right of extraordinary termination for good cause without notice remains unaffected. Oxigen may terminate the Rental Agreement if:
The User is in arrears with rental payments for two consecutive due dates
The User repeatedly delays payments despite prior warnings
The User transfers the Rental Equipment to third parties without permission
The User neglects the equipment, fails to maintain it, or misuses it
If multiple Rental Agreements exist between Oxigen and the User, and there is a right of extraordinary termination for one Rental Agreement, Oxigen may also terminate other agreements without notice if the User’s conduct is grossly contrary to good faith. This includes:
Intentionally damaging a Rental Item.
Concealing or attempting to conceal damage to a Rental Item.
Intentionally causing harm to Oxigen.
Using a Rental Item in connection with criminal activity.
Users may terminate the Rental Agreement (toward the next possible termination date) by providing notice via email.
Liability
Oxigen provides rental items "as is" and does not guarantee their suitability for specific purposes.
Users assume all risks associated with the use of rental equipment.
Oxigen is not liable for any direct, indirect, or consequential damages arising from the use of rental equipment.
Users agree to indemnify Oxigen against claims, damages, or losses resulting from misuse or failure to comply with these Terms.
We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, or technical failures. If such events prevent Oxigen from fulfilling its contractual obligations, Oxigen will notify the User as soon as reasonably possible.
Privacy & Data Protection
Oxigen collects and processes personal data in accordance with our Privacy Policy.
Users consent to the collection and use of their personal information for rental processing and customer support.
Governing Law and Dispute Resolution
These Terms are governed by the laws of Portugal.
If any disputes arise from your use of our platform, they will be resolved through arbitration or mediation in Portugal, unless otherwise agreed upon by the parties involved.
Modifications and Termination to Terms
Oxigen reserves the right to update these Terms at any time. Any changes will be posted on this page, and the updated Terms will take effect immediately after posting.
Continued use of the service after modifications indicates acceptance of the updated Terms.
We reserve the right to suspend or terminate your account if you violate these Terms or engage in any activity that compromises the integrity of the platform. Upon termination, you must immediately return any rented equipment.
We reserve the right to discontinue offering the Application or to modify the Application at anytime in our sole discretion and without notice. Following termination, all such terms that by their nature may survive termination of these Terms shall be deemed to survive such termination.
